MATERIALS SENT TO US All your personal data (first name, last name, e-mail address, etc.) provided to Spellingchange.com will be processed in compliance with our privacy policy (please read also the Designer Release statement displayed below). All information, ideas, images, photographs, artwork and in general material sent to spellingchange.com in relation to this Site will be considered non confidential and for free use of Spelling Change.

By sending said material you assign to the Site the right to use any of such information, ideas and material without any obligation for the Site to acknowledge receipt or make reference or advertisement of your submission and to pay any compensation. You warrant that the material sent to the Site does not infringe upon any third party's right or any law in force and you remain responsible for the contents of the material and will hold the Site harmless from and against any and all claims damages, losses, costs and expenses including the attorneys fees and court costs, arising from or related to such material submitted or mailed.


PRIVACY POLICY
It is our general policy not to make personal information available to   anyone other than our employees, staff, and agents. We configure our list server software to refuse to divulge the email addresses of our list subscribers to anyone other than those whom we authorize. However, we are not the author of this software, and are not responsible for any failures in the software to preserve   subscriber anonymity.

We maintain a variety of physical, electronic and procedural safeguards to protect your personal information. For example, we use commercially reasonable tools and techniques to protect against unauthorized access to our systems. Also, we restrict access to personal information to those who need such access in the course of   their duties for us.

Your own efforts to protect against unauthorized access play an important role in protecting the security of your personal information. You should be sure to sign off when finished using a shared computer, and always log out of any site when viewing personal information.

This Site also provides a "Send to a Friend" feature, which allows you to forward a message or a petition to a friend. The email addresses you enter for your friends are used for this one-time only email, and are not stored by the Site. Your friends will not be put on any sort of mailing list.


DESIGNER RELEASE STATEMENT
1. Grant of Rights. For good and valuable consideration receipt of which is hereby acknowledged, Site user who willingly submits artwork or "Designer” grants Spelling Change/Michael Ian Kaye "(SC/MIK)”, and its licensees, successors, agents and assigns the perpetual, worldwide, non-exclusive, royalty-free right to reproduce, transmit and display, in whole or in part, any designs created, and/or statement, and/or designer’s name, provided by Designer pursuant to this agreement ("Designs”) in connection with the "Spelling Change” project in support of Barack Obama’s political campaign, and in all resulting products, in all media, now known or later developed. Designer agrees that no final products or work need be submitted to him/her for any further approval.
2. Designer's Warranty. Unless otherwise provided in this agreement, Designer hereby represents and warrants to SC/MIK and its licensees, successors, agents and assigns: (a) that no third party has any rights in, to, or arising out of, the Designs supplied hereunder (b) that Designer has full right and power to enter into this agreement; and (c) that all models and any other living persons, or the representatives of any deceased persons whose names or likenesses are used in the Designs, and the owner of any unique or unusual inanimate objects which are used in the Designs, have executed releases allowing unlimited use by SC/MIK (Designer shall supply SC/MIK with copies of said releases with the s hereunder);
3. Indemnity. Designer agrees to hold SC/MIK and its licensees, successors, agents and assigns harmless from and against any loss, damage or expense, including court costs and reasonable attorneys' fees, that they may suffer as a result of a breach or alleged breach of the foregoing warranties or as a result of claims or actions of any kind or nature resulting from the use in any manner of the Photographs. SC/MIK agree to similarly hold Photographer, its assigns and licensees harmless with respect to any material supplied by SC/MIK.
4. Governing Law. The provisions hereof shall be interpreted in accordance with the laws of the State of New York.
